What happens if the domestic help quits?

The Royal Decree-Law 16/2022 of 6 September regulates the special employment relationship of domestic workers, but does not specify the procedure for resignations or voluntary resignations. Therefore, it is necessary to refer to Article 49 of the Workers' Statute, which states that notice of voluntary resignation must be given in accordance with collective labour agreements or local custom. Although there is no deadline established by law, 15 days' notice is recommended.


In the case of voluntary resignation, the employer does not have to pay any compensation to the domestic help. In addition, when terminating the employment of an employee, regardless of the reason for the termination and irrespective of the compensation payment, the employee is entitled to a severance payment.
